What is the legal basis for an Esqase eSignature?

Esqase eSignatures are designed to meet ESIGN and UETA in the United States and Republic Act 8792 in the Philippines. Every signer agrees to an electronic record and signature disclosure chosen from your firm's country: firms in the Philippines and the United States see a statement written for that country's law, and every other firm sees a neutral one. The exact text they agreed to is reproduced on the Certificate of Completion.

What can I send for signature?

A PDF. You open the file, place the fields on it where they belong, choosing from signature, initials, date signed, name, text, and checkbox, and add the people who need to sign. Documents you have drafted in Esqase can be sent the same way once they are in PDF form. When the request completes, the signed PDF becomes that document's current version rather than a second file in your folders, and the copy from before signing stays in its version history.

Do signers need an Esqase account?

No. Each signer is emailed their own secure link and signs from any device. There is nothing to install and no account to create, which matters because the person you are chasing for a signature is the one least likely to sign up for anything to give it to you.

Does everyone have to sign in order?

Not unless you ask for it. Everyone can sign at the same time by default, and each signer sees only the fields assigned to them, so a document with three parties does not expose one signer's fields to another. Turn on Sign in order when one signature has to come first, and each person is invited once the one above them has signed.

How do I know when something has been signed?

Esqase notifies your firm when someone signs, when someone declines, and when a document becomes fully signed, and you choose which of those reach you in your notification preferences. The signers list also shows a per-person status and timestamp, so you can see exactly who you are waiting on.

Can I move a signature field after sending?

Yes. Adjust the field and click Save again so signers see the current version, and anyone who has already signed keeps their signature. If the terms themselves have changed rather than the layout, cancel the request and start a new one instead.

Why is there a clean copy as well as a signed one?

Because they are for different jobs. The signed document carries a watermark, a footer banner, and the certificate pages, which is what you want when it is evidence and not what you want to email a counterparty. The clean copy is the same signatures on the same document with none of that attached. Both download from the completed request, so you send whichever the moment calls for.

How do I know a signed PDF has not been altered?

Verify integrity, on the completed request. Esqase takes a fingerprint of the finished PDF at the moment it seals it, and the check compares the file against that record, so a copy that has been through several inboxes can be confirmed as the original before you rely on it.

Can a document need approval before it goes out for signature?

Yes, if your firm requires document approvals. Sign is held until the review is satisfied, and the review control sits in the document's own header, on the page the signature request is set up on, so the sign-off and the send are one screen rather than two systems.

What happens to finished requests?

Archive them. Archiving moves a completed request out of your active list so the page stays focused on what is still outstanding, and it deletes nothing. The signed document stays where it always was, on the matter and in your documents, as that file's current version, while the clean copy and the certificate download from the completed request itself.
