The four tabs

How does a matter become an injury case?

Open the matter, use the More actions menu, and choose Track as personal injury. The Medical, Damages, Claims, and Settlement tabs appear straight away. A matter whose practice area is named Personal Injury shows them before you do anything, with a button on each tab to start the case. The first time anyone at your firm tracks a matter, Esqase installs the starter pack: five matter field sets, a matter template, a public intake form, and an eight-task case plan. Personal injury is part of the Professional plan.

What is on the Medical tab?

The incident record at the top, then four counts for the case: providers, who is still in treatment, records outstanding, and bills owed. Under them sits one card per treating provider, holding the requests you have sent, the records that came back with their Bates range, and the bills with every payer payment against them. Esqase also warns you about a break of more than 30 days between one provider's last visit and the next one's first, because that gap is what a defense adjuster will argue about.

How does a medical bill become a lien on the recovery?

Record the bill on the Medical tab and tick Treat the balance as a lien on the recovery. The balance is worked out for you, from the amount billed less the provider's adjustment less everything payers have paid, and the claim appears on the Settlement tab marked From a bill. A payer who asserts a lien creates one the same way. Untick the flag and the claim comes off. A bill you mark as the firm's responsibility is listed on its own and never reduces the client's share.

What does the Damages tab total?

Every loss you are claiming, typed as special, general, or other, with a Total claimed line that keeps showing the whole ledger even while a filter is set. A figure that is still provisional carries an Estimate chip and is reported apart from the rest. Underneath, Medical bills by provider totals what each provider billed, adjusted, was paid, and is still owed, read from the Medical tab rather than typed again. Export CSV downloads the ledger with the filters you have set.

Coverage, dates, and access

What does the Claims tab hold?

Three sections. Insurance policies lists the coverage on both sides with its carrier, adjuster, policy and claim numbers, limits, and an Exhausted chip once it has paid out. The negotiation log holds every demand, offer, and counter in the order they happened, with Mark responded and Close entry in each row's menu. Deadlines holds the dates the case has to hit. A policy carries a red Over limit chip while the highest open demand or counter linked to it is above its limit per person.

How do the deadlines work?

The statute of limitations sits at the top of the section as a read-only card with a chip counting the days left, or the days past if it has gone by, and it is kept on the matter rather than on the case record. Under it you add the rest: notice of claim, no-fault application, insurance notice, discovery, mediation, trial, or other, each with a due date, a countdown that turns red on the day it is due, and a reminder a set number of days before. Mark satisfied closes one and Reopen puts it back.

Who at the firm can see the medical side?

Two permissions decide it, and a member can hold one without the other. Personal injury covers the case record, the damages, the policies, the negotiation log, the deadlines, and the settlement. Medical records and bills covers providers, requests, records, bills, payers, and any lien worked out from a bill. A member with the first and not the second reads Medical records are not shared with you where the provider cards would be, and a matter restricted to specific members stays closed to everyone else either way. The settlement authority on a negotiation entry needs Update access for personal injury, and it is never sent to a browser without it.

Settlement and disbursement

How is the deduction ladder ordered?

You choose. Fees first lists the legal fee, the referral fee, the expense reimbursement, then lien payments and outstanding balances. Expenses first moves the reimbursement to the top. That is presentation, and no total changes. The fee model is the arithmetic: a contingency worked out on the gross recovery, or on the gross less the advanced case costs. A referral fee is carved out of the legal fee, so the client is charged that fee once.

What happens when we mark a disbursement line paid?

Esqase asks for a trust account and the client ledger the money is held on, then records a real trust disbursement against that ledger and links it to the line. The line reads Paid, and the transaction appears on the matter's Transactions tab. A payout that would take that client ledger below zero is refused, and a payout always covers the whole line, so split a line before paying part of it.

What is on the settlement statement?

The client, the matter, the fee basis and the deduction order, every payment received totalled as the gross recovery, the deductions in your order, the net payable to the client in a box, anything the firm has taken on rather than deducted, your firm's acknowledgment wording, and the client's signature and date lines. It is filed as a PDF in the matter's document folder, and Send for signature hands it to the same signing flow as any other document.

What does Esqase watch across every matter?

The Personal injury group in the sidebar holds the whole practice: an overview, a records worklist, a liens register, the settlements list, every deadline, and six reports, each exportable as a CSV. Esqase also sends a reminder for five kinds of date, a statute of limitations date approaching, a records follow-up, a personal injury deadline, a lien response, and a demand response, once per record per date. A statute date that has already passed stops reminding, and the overview card is where it surfaces. A matter you are not on reads Restricted matter, and its amounts are still counted.
